1. Acceptance of Terms

By creating an account or using the services provided by EquiStable LLC ("EquiStable," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

2. Description of Service

EquiStable provides a comprehensive SaaS solution for equestrian facility management, including but not limited to resource booking, horse health management, feed planning, and AI-powered ride analysis (the "Services").

3. User Accounts

You are responsible for safeguarding your account and for all activities that occur under it. You must provide accurate and complete information and keep your account information updated. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

Fees: Certain features of the Services require payment of fees, either as a one-time purchase (e.g., credit top-up) or on a recurring subscription basis (e.g., Facility SaaS Subscription, Rider Premium Subscription).
Billing: We use Stripe, a third-party payment processor, to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of Stripe.
Internal Credit System: Users can purchase credits to pay for services within the platform. Credits are non-refundable and have no cash value.

5. User Content and Data

You retain ownership of all the information and content you upload to the Services, including your personal data, horse data, and ride data ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works (such as those resulting from our AI analysis) for the sole purpose of operating, providing, and improving the Services for you.

6. Disclaimers

THE SERVICES ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. THE AI-POWERED MOTION ANALYSIS AND ANY HEALTH-RELATED RECOMMENDATIONS ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL VETERINARY ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR VETERINARIAN WITH ANY QUESTIONS YOU MAY HAVE REGARDING A HORSE'S MEDICAL CONDITION.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EQUISTABLE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

8. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
